These Terms of Use apply to backchatgroup.com.au (the site), operated by BACKCHAT PTY LTD (ABN 53 658 108 831) under the BackChat Group name (BackChat, we, us or our). By using the site, you agree to these terms. If you do not agree, please do not use the site.
1. About this site
The site provides general information about BackChat Group, its divisions, work, news and ways to contact us. Content is provided for general information only. It is not professional, financial, legal or other advice and should not be relied on as a substitute for advice appropriate to your circumstances.
2. Enquiries are not agreements
Submitting an enquiry, receiving an automated confirmation or corresponding with us does not create a partnership, agency, employment, talent-management, production, supply or other binding agreement. Any engagement is subject to separate written terms agreed by the relevant parties.
3. Acceptable use
You must use the site lawfully and must not:
- interfere with the site’s operation, security or other users;
- attempt to gain unauthorised access to systems, accounts or data;
- introduce malicious code, scrape the site at a harmful rate, or bypass technical controls;
- submit unlawful, misleading, abusive, defamatory or infringing material;
- impersonate another person or misrepresent your authority to act; or
- use site content in a way that infringes intellectual property or other rights.
4. Intellectual property
Unless stated otherwise, the site and its content, including text, graphics, photographs, video, audio, layout, logos, trade marks and software, are owned by or licensed to BackChat Group or a relevant rights holder and are protected by intellectual property laws.
You may view the site and make a temporary copy for personal, non-commercial use. You must not reproduce, publish, adapt, distribute, commercially exploit or create derivative works from site content without prior written permission from the relevant rights holder, except as permitted by law. Nothing on the site grants a licence to use a BackChat name, logo or trade mark.
5. Accuracy and availability
We aim to keep the site useful and current, but information may be incomplete, change without notice or contain errors. Images, past work, partners, creators, services and availability may change and do not constitute a continuing representation or offer. We may change, suspend or withdraw any part of the site at any time.
6. Third-party sites and services
The site may link to BackChat division websites, social platforms and other third-party sites. Links are provided for convenience and do not mean we control or endorse every external page, product, statement or privacy practice. You use third-party sites under their own terms and at your own risk.
7. Privacy
Our Privacy Policy explains how we handle personal information submitted through or generated by the site.
8. Disclaimers
To the maximum extent permitted by law, the site and its content are provided on an “as available” basis. We do not guarantee that the site will always be available, uninterrupted, secure, error-free or free from harmful components, or that content will be complete, accurate or suitable for a particular purpose.
Nothing in these terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law.
9. Liability
To the maximum extent permitted by law, BackChat Group and its personnel are not liable for indirect, consequential, special or incidental loss arising from use of, inability to use, or reliance on the site or a linked site. Where liability cannot be excluded but can lawfully be limited, our liability is limited to the minimum remedy permitted by applicable law. This clause does not limit liability that cannot lawfully be limited.
10. Suspension and enforcement
We may block or restrict access, disregard submissions, and take other reasonable action where we believe a person has breached these terms, threatened the site or another person, or acted unlawfully.
11. Changes to these terms
We may update these terms by publishing a revised version on this page. Changes apply from publication. Your continued use of the site after that time constitutes acceptance of the revised terms.
12. General
If any part of these terms is invalid or unenforceable, it is read down or severed to the extent necessary without affecting the remaining terms. A delay in enforcing a right is not a waiver. These terms, together with the Privacy Policy, are the entire agreement about use of this site and do not replace any separate written agreement with BackChat.
13. Governing law
These terms are governed by the laws of Western Australia, Australia. You submit to the non-exclusive jurisdiction of the courts of Western Australia and courts entitled to hear appeals from them.
14. Contact
